Terms of Service

Welcome to XiteAI. These Terms of Service ("Terms") constitute a legally binding agreement between you and XiteAI Technologies ("XiteAI," "we," "our," or "us") governing your access to and use of our ecosystem. This includes our corporate domain (xiteai.com), our primary educational AI application (chat.xiteai.com), and all associated APIs, tools, and features (collectively, the "Services").

By registering for an account or otherwise accessing the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you are prohibited from utilizing the Services.

A. The XiteAI Ecosystem

1. Service Overview

XiteAI is an advanced, intent-driven educational platform. We provide dynamic access to top-tier language models through intelligent routing, paired with native study utilities. Features include, but are not limited to, the Cheat Sheet Studio, MCQ Studio, PYQ Analyzer, and multi-modal document rendering.

2. Third-Party Integrations & Providers

To deliver our Services, we aggregate outputs from third-party artificial intelligence engines and search APIs. XiteAI does not claim proprietary ownership over the underlying third-party foundation models. Your use of these outputs is simultaneously subject to the safety policies and acceptable use guidelines of our external providers.

3. Account Security

You are solely responsible for all activity conducted under your XiteAI account. You must employ strong security practices and notify us immediately at security@xiteai.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that appear compromised or actively violate these Terms.

B. Subscriptions, Limits & Billing

1. Plan Structure and Resource Allocation

XiteAI operates on a multi-tenant, tiered model (Free, Prime, and Pro). Access to heightened context windows, advanced document ingestion, and increased file-upload caps are contingent upon your active subscription tier. XiteAI reserves the right to impose technical limits, including contextual token truncation, to preserve platform stability and prevent token bloat during extended sessions.

2. Payments and Gateway Processing

Paid tiers require a valid payment method processed by our authorized third-party gateways. By upgrading to Prime or Pro, you authorize us to trigger recurring billing intervals as selected during checkout. Failure to remit payment will result in an automatic downgrade to the Free tier, which may immediately restrict access to historically deep contexts or premium features.

3. No-Refund Policy

Because compute resources are allocated immediately upon subscription, all transactions are strictly non-refundable unless explicitly mandated by prevailing consumer protection laws in your local jurisdiction (e.g., EU, UK right-of-withdrawal). Canceling your subscription guarantees you will not be billed in the subsequent cycle, but does not trigger a prorated refund for unused quotas or the remainder of the current cycle.

C. Platform Conduct & Usage Rights

1. Acceptable Use Policy

The XiteAI platform is designed to augment learning and academic preparation. You are expressly prohibited from:

  • Submitting prompts designed to bypass structural safety barriers, generate illegal, hateful, or abusive material, or infringe on third-party intellectual property.
  • Deploying automated scripts, scrapers, or reverse-engineering tactics against our servers or attempting to spoof subscription tiers.
  • Uploading highly sensitive, regulated data (such as financial or protected medical health information).
  • Utilizing the platform for academic fraud. XiteAI provides interactive study mechanisms; it is not a tool designed to bypass institutional honor codes.

2. Ownership of Outputs

Subject to the licenses of our upstream AI providers, XiteAI transfers all rights to the generated outputs to you. However, you grant XiteAI a perpetual, worldwide, royalty-free license to transmit, render, and process your inputs and outputs solely for the functional operation of the Services (e.g., storing your chat history and generating your Cheat Sheets).

3. Output Disclaimer

Artificial Intelligence is probabilistic. XiteAI makes no guarantees regarding the factual accuracy, reliability, or completeness of any output, including mathematical equations, prioritized study lists, or factual claims. You must independently verify all outputs before relying on them for examinations or academic submissions.

D. Legal Provisions

1. Age Restrictions

You must be at least 13 years of age, or the legal age of digital consent in your jurisdiction (e.g., 16 in certain EU states), to use XiteAI. Users who are minors in their jurisdiction may only utilize the platform under the active supervision of a consenting parent or guardian.

2. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XiteAI Technologies AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR ACADEMIC STANDING, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

3. Binding Arbitration & Class Action Waiver

Please read carefully. By accepting these Terms, you agree that any dispute arising out of or relating to this agreement shall be resolved through mandatory, binding, individual arbitration. You waive any right to bring a claim in a traditional court of law before a judge or jury, and explicitly waive your right to participate in any class-action, representative, or consolidated legal proceeding.

4. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction where XiteAI Technologies is officially registered, overriding conflict of law rules. Provided, however, that overriding local consumer rights in major international regions (such as North America or Europe) are preserved where mandatory by statute.
